New legislation affects major hazard facilities

MINING companies operating major hazard facilities (MHF) will be affected by new legislation introduced to NSW on 13 October 2008.

MHFs are locations such as processing plants, oil refineries and large fuel and chemical storage sites where large quantities of hazardous materials are stored, handled or processed.

As part of the amended legislation, additional notifications are now required on top of existing Dangerous Goods notifications.

MHF users must notify WorkCover NSW of their operations by 12 January 2009, and businesses intending to do so must notify the authority within three months of a decision.

Notification is compulsory for all operators if their facility exceeds 10% of the dangerous materials threshold, which is outlined on the government website.

According to WorkCover NSW, the new regulation will reduce risks and protect the health and safety of people in the event of a major accident.
