Mining safety case reopened

NSW Department of Primary Industries director of mine and safety performance Morrison's appeal against a judgment over a mining safety case has begun in the Industrial Relations Commission in Sydney.

The case involves the a former Allied Coal managing director John Milnerm, mine manager Stephen Baldwin and mine worker Gregory Aspinall, who died at Bellambi West Colliery on 20 December 2000.

Aspinall had been working in a crew with six other men when a machine broke down underground about 9pm. He and a co-worker were installing props to support the roof near the broken machinery when the mine roof collapsed.

Morrison alleged the company failed to provide safe work systems and failed to provide information, instructions and training necessary to ensure workers' safety.

The appeal is expected to run until 25 July 2009.
