Judge says that union member’s evidence on mining safety incident will stand

JUSTICE Duncan McMeekin has dismissed Walter Mining’s application to discount evidence given by a union member on a safety incident.

The incident involved a worker who was crushed by a shuttle car at the Moranbah North coal mine in 2007.

Stephen Smythe from the Construction, Forestry, Mining and Electrical Union gave evidence that was critical of operations and procedures at the mine.

The mining company had argued that Smyth gave opinions that went beyond his level of expertise.
