THE WESTERN Australian Mines Minister, Norman Moore says that BHP Billiton’s safety record could never become public.

Moore says that he is seeking legal advice on whether the report can be made public.

According to the Minister, the State Solicitors Office has advised him that the information may have to be suppressed until its legal implications are assessed.

The Office has warned that if there is any prospect that the report might contain potential litigation against the mining company, then it's not in the best interests of the prosecution to make it public ahead of the prosecution

Five people have been killed while working at BHP Billiton sites in the state in the past nine months.
